Your personal contacts are the family, friends and neighbors you want us to notify in an emergency. You should have at least (2) two personal contacts. Place them in the order you want them called. In an emergency Alert1 will call them in order until at least one is reached. Do not include local 9-1-1 information on this form. Alert1 will obtain 9-1-1 and other local emergency numbers for you.

TERMS & CONDITIONS (Read) TERMS AND CONDITIONS OF SERVICE 1. Contract. This is a contract between the Customer and Alert1 Services, Inc., hereinafter referred to as Alert1. Customer includes the Payer and Subscriber identified on the front of this contract. Customer and Alert1 agree to the provisions set forth on this form.2. Customer's Obligations. Customer agrees to read this contract and the written instructions and options provided with the Alert1 Personal Emergency Response System (hereinafter referred to as Equipment) prior to installation. Customer agrees to test the Equipment monthly by activating the personal transmitter. This and all other transactions with the monitoring center are electronically recorded. Customer is responsible to inform Alert1 of any changes in any information supplied for use in emergencies. 3. Term Of Contract. This contract starts on the date shown on the front page as Date On-Line. This contract is Annual, Quarterly, or Monthly as stated on the front page immediately after Monitoring Service Fee. The contract will continue automatically on the monthly, quarterly, or annual basis after the initial term, provided the Customer or Alert1 does not give advanced written notice to the other canceling the contract. If Customer cancels service, the Equipment must be returned to Alert1 prior to the cancellation taking effect. Accounts are active and billable until Alert1 receives all Equipment supplied by Alert1 to Customer. 4. Payment. By accepting this contract the Customer authorizes Alert1 to charge Customer's credit card on file or debit checking account for payment. Customer agrees to pay in full the Monitoring Service Fee indicated for a period of not less than the term of service indicated. The monthly average price is discounted according to the contract term and there is no refund for early cancellation. If requested, a statement will be provided to the Customer by Alert1. Customer may pay in advance up to 12 months payment to insure that the monitoring fee will not change for up to 12 months. Alert1 may impose a late fee of $10.00 per month on any past due account. Past due accounts may be charged $350.00 for Equipment if account remains in a delinquent status and Equipment is not returned.5. Contract Termination. If the Equipment is destroyed or substantially damage dby fire or other catastrophe making it impractical to continue service, then either Alert1 or the Customer may cancel this contract by giving written notice to the other. If the Customer does not pay any amount owed to Alert1 by the tenth (10th) day after such payment's due date, Alert1 shall have the right to cancel this contract and terminate service ten (10) days after written notice is sent to the Customer. If service is terminated by the Customer, cancellation is effective the date all Equipment is received by Alert1. Whether cancellation is by Alert1 or the Customer, failure to return Equipment will result in a charge of $350.00 to cover the cost of Equipment. Alert1 reserves the right to require Equipment return at any time 6. Services Provided. Alert1 agrees to provide and perform the following services: Continuous 24 hour monitoring service of designated signals from the Equipment on the Subscriber's premises. Upon receiving a signal from the Equipment, Alert1 shall use reasonable efforts to orally notify the appropriate emergency agency or other persons designated on the Client's Customer Forms, by telephone, advising of the existence and nature of such signal. Alert1 shall pay any telephone toll (Long distance) charges for incoming calls to the monitoring station and for notifying the appropriate party designated on the Client's Customer Forms.7. Installation Requirements. Alert1 recommends connection to an RJ31X telephone jack supplied by a local telephone company when telephone extensions are present in the Customer's residence. Your RJ31X jack, installed by the telephone company, shall be billed by it. Failure to install an RJ31X telephone jack by Customer shall relieve Alert1 of any and all liabilities for any failure to communicate that may occur as a direct result of such failure. Service requires connection to a private telephone line. Alert1 is not responsible in any way for the operation or maintenance of any appliance, instrument, or the telephone system to which the Equipment is connected.8. Authorization. This agreement authorizes Alert1 to release any information provided on the Customer Forms to anyone as deemed necessary. Customer authorizes Alert1, itself or through others, to enter the premises to install, maintain, and remove the Equipment and to make inspections, tests, repairs and changes to the Equipment. Alert1 shall have no obligation to repair or redecorate or pay the repair or redecoration of any portion of the premises or appliances in the premises upon removal of the Equipment.9. Service Interruptions. Alert1 shall not be liable for any delay or non-delivery of the Equipment caused by circumstances beyond Alert1's direct control. Alert1 shall have no liability for any delay in the installation or maintenance of the Equipment or for interruption in service due to any cause beyond its control. Alert1 shall resume performance of its contract obligations after the cause for delay or interruption has been corrected.10. Limitation Of Liability. Alert1 is not an insurer and the amount charged is based only on the value of the monitoring services provided. Alert1 cannot guarantee in any way that the Equipment will prevent accidents, death or personal injury to you or others, fire, property damage, illegal entry or undue delay in any emergency service response from occurring and is not liable in any manner for any loss or damage resulting therefrom. Alert1 is not responsible or liable for any injury, loss or damage caused by persons responding, failing to respond, or failing to respond promptly to Customer's alarms. Alert1 is not responsible or liable for any injury, loss or damage caused in whole or in part by damage to the Equipment while in your possession, improper installation, unreasonable use or abuse of the Equipment, failure to provide proper maintenance or to follow the written instructions provided.11. Limitation Of Damages. Except as limited above, should any loss, damage or injury occur to the premises, or to any person or property on the premises, as a result of a failure of the Equipment, the liability, if any, of Alert1 shall be limited to Two Hundred Fifty ($250.00) Dollars as liquidated damages and this remedy shall be exclusive. In no event will Alert1 be liable to Customer for consequential, special or other damages of any nature. This limitation applies irrespective of the nature, severity and cause of such injury, loss or damage, and irrespective of the legal theory of liability asserted against Alert1.12. Indemnification. Customer agrees to and shall indemnify, defend and hold harmless Alert1, its employees and agents for and against all claims, lawsuits and losses of every nature, irrespective of legal theory, brought or sustained by persons or entities other than Customer. The Customer agrees to pay any costs and charges related to unnecessary alarms caused by acts or omissions of the Customer or persons residing with or visiting Customer.13. Limitation Of Warranties. If the Equipment fails to function during the term of this contract or any renewal thereof due to a defect in materials, workmanship or design, Alert1 shall, at its sole option, repair or replace the Equipment at its expense, and shall be Customer's sole and exclusive remedy for any breach of warranty by Alert1. The foregoing limited warranty does not cover failure to function caused by damage to the Equipment while in your possession, improper installation, unreasonable use or abuse of the Equipment, failure to provide proper maintenance or to follow the written instructions provided. THE REMEDIES PROVIDED IN THE ABOVE EXPRESS LIMITED WARRANTY ARE THE SOLE AND EXCLUSIVE REMEDIES AVAILABLE TO THE CUSTOMER. NO OTHER EXPRESS WARRANTIES ARE MADE. ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR USE, ARE LIMITED IN EXTENT AND DURATION AS SET FORTH ABOVE. IN NO EVENT SHALL Alert1 BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES.14. Agents. Alert1 reserves the right to appoint an agent to perform its monitoring service obligations. Such agent shall be entitled to avail itself of any contract provision or defense available to Alert1 with respect to any claim or cause of action whatsoever arising out of this agreement.15. Time Limitations. Customer must commence any claim for damages against Alert1 within one year of when Customer knew or should have known of such claim for damages. Any such claim not filed within one year shall be forever barred. 16. Law Governing, Venue & Waiver Of Jury Trial. This contract is made in, and shall be governed by the laws of the Commonwealth of Pennsylvania. Any and all legal proceedings instituted against Alert1 by Customer shall be commenced in the Court of Common Pleas of Lycoming County, Pennsylvania. Notwithstanding the above limitation, Customer waives his/her right to a jury trial in any jurisdiction concerning any claim against Alert1.17. Survival. If any sentence or provision of this contract is determined to be unenforceable, then the remaining sentences and provisions will remain a part of this contract without the unenforceable sentence or provision.18. Assignment, Successors and Assigns. This contract is non-transferable by the Customer to any person without the prior written consent of Alert1. This contract is fully assignable by Alert1. All the terms and provisions of this Contract shall be binding upon Alert1's and Customer's heirs, personal representatives, transferees, successors and assigns.19. Entire Agreement. This contract contains the entire agreement between the Customer and Alert1 and can be changed only by a written document signed by the Customer and Alert1. INTERNET Alert1 does not guarantee the performance or the availability of the website at a particular time or for a particular purpose. Alert1 also does not guarantee, represent, or warrant that the website will be error-free, free of any viruses or other harmful components, or that any errors or defects in the website will be corrected. Alert1 reserves the right in its exclusive discretion at any time without notice to amend, limit, modify, suspend, or terminate the website. All rights are reserved.
